I. IntroductionBy commissioning me (“The Artist”, "Katie", "Katie Smafuu", "I", "Me", "My"), you (“The Client”, "You", "Your") agree to the following terms. Failure to comply will result in blacklisting. During the matter of a dispute, these terms shall be referred to.This commission sheet, including (but not limited to) the products, prices, terms of service, rules, and information, is subject to change without announcement. Suppose anything changes during the commission process, the artist will stick to the original terms agreed upon with the client (unless significant changes and extras are added to the commission after the changes in the commission sheet are applied in which the client will be charged for said changes and extras according to the most recent version of the commission sheet in which these additions are sent).As the client, you are responsible for reading through the most current edition before placing a commission. If anything changes during the process of your commission, the changes will only affect you if they are of absolute importance, which I will determine. If you choose not to read any part of my commission sheet, please remember that all its contents still apply to you if you've commissioned me, regardless of whether you've read it. It is your responsibility as a client to be aware of what product you are buying and the connotations that stem from it. No fault will be on me if you choose not to read the information I have provided.II. Rights, Usage, and LicensingUnless explicitly and officially negotiated, Katie Smafuu will retain rights to the artwork produced. This includes distribution, selling, printing, re-uploading, and editing; as well as any WIPs/sketches that have been exchanged during communication. The client retains rights to any original characters, ideas, and concepts they own.Commissioned pieces are for the client's personal, non-commercial, and non-profit use only. You are not allowed to submit, sell, edit, manipulate, warp, or reuse these pieces under any circumstance unless its use and its goals of the piece is communicated and agreed upon by both parties before I start with the commission.In the event that I do allow rights to repost, sell, reuse, or edit my work, the client must give proper credit to me as the original creator. Otherwise, all rights given to the client over the work will be relinquished. Writing CTTO (credits to the owner) and its other variants without mentioning the name or link of the artist are not considered as proper credit.The artist has the right to use the commissioned piece and its process as part of their portfolio, their streams, or repost said pieces in different platforms, both in the real world and the digital space, whenever the artist deems appropriate. The client will be credited and/or tagged in these posts and streams by default. If you'd like to be uncredited and/or untagged in these posts and streams, please do inform me.I reserve the right to refuse a commission to anyone, at my own discretion.If the client intends to use the commissioned piece for monetization, or on a platform that the client intends to receive profit from, I am willing to license those rights for a set percentage of revenue to be agreed upon between the client and the artist.REGARDING ARTIFICIAL INTELLIGENCE-RELATED USE:
Do not use or involve any of Katie Smafuu's works in any manner for purposes of training generative artificial intelligence ("generative AI"), including, without limitation, technologies that are capable of generating works in the same style or genre as Katie Smafuu's artworks. The client will not sublicense others to reproduce and otherwise use Katie's work in any manner for purposes of training generative AI and the like.
III. CaveatWhile your commission is important to me, it doesn't mean it's going to take precedence over my personal life. This would mean that there will be times where I will show inactivity due to these events. Regardless, I will do what I can to inform you if such event arises that may hinder my ability to work on your commission.If ever the client needs to have a deadline set for a commission, it must be stated before I accept the commission and agreement by both parties. If needed within 14 days after the agreement, the commission may be prioritized for an extra fee of 30% of the base price. I will not be bound by any deadlines set after the approval of the commission.Feel free to reach out if there is something not stated above that you have a question about. Fill up the commission form
For the artist to begin the requested piece, the client must submit a commission form. If their desired project is not on the list, the client can contact the artist beforehand. Once the client has filled in the required areas in the form (e.g., contact details, canvas formatting, references, an overview of the client's desired art), filling up the "Extras/Notes" section is recommended, especially if the client has a specific direction for the piece (e.g. mood of the illustration, purpose of the piece). Afterwards, the artist will contact the client through the provided contact details for any clarifications and requests. Once the client and the artist agree on the direction of the piece and the artist approves the commission, they will proceed to the next step.
Wait for the payment request and pay it to start the commission
A downpayment of 80% is expected before the artist begins working on the commission. The client is also welcome to provide full payment as well. Expect a message from the artist within 2 to 3 business days regarding accepting the commission payment. Once the commission payment is accepted, the client will have a week to pay the remaining balance, or the artist will not go through creating the commission. Once that happens, the client will have to request a commission again, with an explanation for why they did not meet the payment deadline. It is essential for the client to send their payment only when the artist has sent the payment request.
Adjustments and Revisions
The client is free to request multiple adjustments and revisions during the sketch phase a reasonable number of times. However, once the sketch is approved, the client can only ask for two more adjustments and revisions during the later stages, provided that the errors are not on the artist's part. Additional fees apply for further adjustments and revisions, starting at 20 USD, depending on the complexity.
Refunds and Cancellations
Refunds will not be applicable when the client cancels the commission after the downpayment has been paid. However, a full refund will be given when the artist chooses to cancel the commission at any point in the process, provided that the client has not harassed the artist in any way or form (e.g., stalking, abuse, insulting and disrespectful behavior) in which you will only receive a 20% refund for reparations. If the payment has not been sent, the client can cancel the commission for free.
